Important Copyright Information

WARNING CONCERNING COPYRIGHT RESTRICTIONS

The copyright law of the United States (Title 17, United States Code) governs the making of photocopies or other reproductions of copyrighted materials.

Under certain conditions specified in the law, libraries and archives are authorized to furnish a photocopy or other reproduction. One of these specified conditions is that the photocopy or reproduction is not to be "used for any purpose other than private study, scholarship, or research". If a user makes a request for, or later uses, a photocopy or reproduction for purposes in excess of "fair use", that user may be liable for copyright infringement. This institution reserves the right to refuse to accept a copying order if, in its judgment, fulfillment of the order would involve violation of copyright law. The Library does not limit the number of interlibrary loan requests made by LaGuardia faculty and staff. However, the requests for articles must comply with the CONTU guidelines (see below).

The National Commission on New Technological Uses of Copyrighted Works (CONTU) has developed a set of guidelines to assist libraries in fulfilling their duties while adhering to copyright law. The CONTU guidelines permit copying during one calendar year of no more than five articles from a single journal title, not owned by the library, dated within the past five years.

This means that the Interlibrary Loan Department staff can order a total of only 5 articles from a single journal title dated within the past 5 years. The library must pay royalties due to the publisher for each article in excess of 5. Since the Library does not have a budget to pay these fees, the patron will be asked to pay the fees for the request(s) that exceed the guidelines.

Also, if no requests have been made previously by another patron for a journal title, one patron may submit only 3 requests per year for an article from the same journal title without paying fees.

For additional requests for the same journal title, patrons will receive an email asking if they are willing to pay the fees. If the patron does not agree to pay, the request(s) will be canceled.
